TERMS OF SERVICE

These Terms of Service (“Terms”) apply when you use the Precision Institute of Dance website, submit an enquiry or booking, purchase a product, or access a service offered by Precision Institute of Dance (“Precision”, “we”, “us” or “our”).
By making a booking, enrolment or purchase, you confirm that you have read and accepted these Terms. If the participant is under 18, the parent or legal guardian making the booking accepts these Terms on the participant’s behalf.
These website Terms operate alongside any enrolment agreement, Parent Handbook, payment plan, competition agreement, course agreement, waiver or other terms provided for a specific service. If there is an inconsistency, the specific written agreement for that service takes priority.
1. Our services
Precision offers dance classes, trial weeks, private lessons, personal training, workshops, studio hire, performances, examinations, competitions, online training, memberships, courses, assessments, merchandise and related services. Availability, eligibility and inclusions vary by program.
A complimentary trial week is subject to suitable class availability and is generally offered to prospective students who are considering enrolment. We may recommend or change a trial placement to protect safety and ensure an appropriate age and ability level.
2. Accurate information and authority
You agree to provide complete and accurate contact, participant, billing, medical and emergency information and to update it promptly when it changes.
If you make arrangements for a child, you confirm that you are their parent, legal guardian or otherwise authorised to act for them. You must tell us about any parenting order, collection restriction or other circumstance that affects who may receive information or collect the child.
3. Enrolment and class placement
Submitting a form does not guarantee a place. Enrolment is confirmed only when Precision accepts the registration and any required payment arrangement is completed.
Class placement is based on factors including age, experience, safety, learning needs and teacher assessment. We may recommend a different level or class if it is reasonably considered more suitable.
4. Fees and payments
Current prices and payment options are displayed on our website, enrolment materials or invoices. You agree to pay all disclosed fees by their due dates and authorise any payment arrangement you separately approve.
Fees may include tuition, registration or administration fees, private lessons, costumes, examinations, competitions, workshops, merchandise and other optional activities. Optional costs will be disclosed before commitment wherever reasonably practicable.
If a payment fails or becomes overdue, we may contact you, retry an authorised payment, apply a disclosed and reasonable late fee, restrict optional services, or suspend participation after reasonable notice. Please contact us early if you are experiencing payment difficulty.
5. Cancellations, withdrawals, credits and refunds
Trial bookings, private lessons, personal training, studio hire, workshops, courses and other appointments may have service-specific cancellation periods shown at booking.
For ongoing dance enrolments, withdrawal and notice requirements are set out in the current enrolment agreement or Parent Handbook. Fees may remain payable during a notice period where that requirement was disclosed before enrolment.
Missed classes are not automatically refundable or transferable. Where practical, we may offer an appropriate make-up class, credit or alternative, but this is not guaranteed.
Merchandise, costumes, competition fees, examination fees and other amounts committed to third parties may be non-refundable once ordered or paid, except where required by law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, refund right or other right that cannot lawfully be excluded under the Australian Consumer Law. Any statement that an item or service is “non-refundable” is subject to those rights.
6. Timetable and service changes
Teachers, rooms, timetables, venues, delivery methods and program content may change for operational, safety or staffing reasons. We will give reasonable notice of material changes where practicable and will consider a suitable alternative if a change significantly affects the service purchased.
We may cancel or reschedule a class, lesson, event or service due to illness, insufficient enrolments, venue issues, emergencies, government directions, extreme weather or circumstances beyond our reasonable control. Depending on the circumstances and applicable law, we may offer a replacement, credit, reschedule or refund.
7. Health, safety and participation
Dance, acrobatics, fitness and performance activities involve physical exertion and an inherent risk of injury. Precision uses qualified instruction and appropriate progressions, but cannot guarantee that injury will never occur.
You must disclose relevant injuries, medical conditions, allergies, medication, disabilities, pregnancy or support needs before participation and update us if circumstances change. Participants must follow teacher instructions, use equipment appropriately and only attempt skills approved by the supervising teacher.
You are responsible for obtaining medical clearance where appropriate. Our teachers do not provide medical diagnosis or treatment. In an emergency, you authorise us to seek first aid, medical assistance or ambulance care when reasonably necessary. Any external medical or ambulance cost remains your responsibility unless the law provides otherwise.
8. Arrival, departure and supervision
Parents and guardians are responsible for ensuring children arrive safely, are collected promptly, and are supervised outside their scheduled class or an expressly supervised studio activity.
You must tell us in writing about authorised collectors or any collection restriction. Precision is not responsible for a participant before they have been received into the scheduled activity or after the activity and reasonable collection period have ended.
9. Conduct and safeguarding
Participants, families, visitors and clients must behave respectfully toward students, staff and other families. Bullying, harassment, discrimination, threats, unsafe behaviour, abuse, deliberate damage and serious disruption are not accepted.
We may take reasonable steps including a meeting, behaviour plan, removal from an activity, suspension or termination where required for safety, wellbeing or studio operations. Wherever appropriate, we will explain the concern and give a reasonable opportunity to respond.
10. Photography and recordings
Promotional photography and video are governed by separate consent choices and our Privacy Policy. You may not photograph, film or record another child, client, class or staff member without permission.
Performance and event recordings may be subject to venue, music-licensing, competition or child-safety restrictions.
11. Online services and intellectual property
Course materials, training programs, choreography, videos, assessments, branding, website content and other materials supplied by Precision remain owned by Precision or the relevant licensor unless stated otherwise.
You receive a personal, limited, non-transferable right to use purchased materials for their intended purpose. You must not copy, resell, publish, share login access, distribute or commercially exploit them without written permission.
You are responsible for keeping account credentials secure and for activity under your account. Tell us promptly if you believe an account has been accessed without permission.
12. Merchandise and preorders
Product images and colours may appear differently across screens. You are responsible for selecting the correct size and checking any size information supplied.
Preorder timeframes are estimates and may be affected by suppliers. If we cannot supply an ordered item, we will provide an appropriate replacement, credit or refund in accordance with your rights.
13. Website information and third-party services
We take reasonable care to keep website information accurate, but content may change and occasional errors may occur. Please contact us before relying on information that is important to a booking or purchase.
Our website may link to or embed third-party platforms. Those services have their own terms, availability and privacy practices. We are not responsible for an external service except to the extent required by law.
14. Privacy
Our collection and handling of personal information is explained in our Privacy Policy. By providing information, you confirm that you are authorised to do so and understand that we will use it to deliver and administer our services.
15. Liability
To the maximum extent permitted by law, Precision is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by inaccurate information, failure to follow safety instructions, misuse of facilities or equipment, or events outside our reasonable control.
Where liability cannot lawfully be excluded but can be limited, our liability is limited only to the extent permitted by law. Nothing in these Terms excludes liability or rights that cannot legally be excluded.
16. Suspension or ending services
You may stop using our website or services subject to any applicable notice and payment obligations.
We may refuse, suspend or end access where fees remain unpaid after reasonable notice, these Terms are seriously or repeatedly breached, safety is at risk, unlawful conduct occurs, or continuing the relationship is no longer reasonably workable. We will act fairly and consider the circumstances.
17. Changes to these Terms
We may update these Terms to reflect changes to our services, systems or legal obligations. The current version and updated date will appear on this page. Material changes affecting an existing ongoing service will be communicated where reasonably practicable and will not remove rights already accrued.
18. Governing law
These Terms are governed by the laws of Western Australia and applicable Commonwealth laws. The parties submit to the courts with jurisdiction in Western Australia.
